1. Introduction
These Master Terms of Service ("Master Terms") govern your access to and use of the services provided by HeavyTesting / HVTLabs ("HVTL," "we," "us," or "our"), including WaveBank.
"Services" means everything we provide now or in the future, including the WaveBank Discord bot, its commands, panels, buttons and messages, the WaveBank website and dashboard, any staff or administration tools, any application programming interfaces, and any new features, products, plans or integrations we add later.
By accessing or using the Services, you agree to these Master Terms and to any additional agreements that apply to what you do.
2. Related Agreements
Depending on your activity, you may also be asked to accept:
- The User Terms of Service, which apply to everyone who uses the Services.
- The Economy Manager Terms and End User License Agreement, when you create, configure or manage an economy.
- The Discord Server Terms, when you add, link, unlink or configure the Services in a Discord server.
These agreements, our Privacy Policy, and any rules or notices we show inside the Services for a specific feature together form the agreement between you and HVTL. If they conflict, the agreement that specifically covers the activity takes precedence for that activity, unless the law requires otherwise.
3. Virtual Currency
Economies in WaveBank use virtual currency and virtual items ("Virtual Currency").
- Virtual Currency has no real-world value. It is not money, a deposit, a security, a stored-value product, or property you own.
- WaveBank is not a bank, a payment service, a money transmitter, or a financial institution, and accounts in WaveBank are not deposit or financial accounts.
- Virtual Currency cannot be exchanged, redeemed or withdrawn for real money, goods or services from HVTL, and HVTL will never buy it back.
- You may not buy, sell, trade, rent or transfer Virtual Currency, accounts or economies for real money or anything else of real-world value, inside or outside the Services, except through a feature we expressly provide for that purpose.
- Balances can change, be frozen, reset or removed, for example by an economy's owner or team, by a wipe, by the deletion of an economy, by an error, or by HVTL enforcing these terms. Nobody is owed compensation for Virtual Currency, except where the law requires otherwise.
4. Acceptable Use
You agree not to use the Services to:
- Break the law, Discord's Terms of Service or Community Guidelines, or the rights of others.
- Exploit bugs, vulnerabilities or unintended behavior, or keep using one after you discover it, instead of reporting it to us.
- Use bots, scripts, macros, alternate accounts or coordinated activity to farm income, get around limits, or gain an unfair advantage.
- Interfere with the operation, security or availability of the Services, or put an unreasonable load on them.
- Access systems, data, economies or accounts without authorization, or try to.
- Commit fraud or scams, impersonate others (including HVTL staff), or misrepresent your authority.
- Get around access controls, permissions, rate limits, restrictions or bans.
- Harass, threaten, spam or deliberately harm others, including through names, notes, reasons, or other text you enter.
- Copy, scrape, or reverse-engineer the Services, except where the law allows it.
We may investigate suspected violations and take reasonable action to protect the Services and their users.
5. Intellectual Property and License
HVTL and its licensors own the Services and everything in them, including the software, branding, designs, text, and documentation. "WaveBank," the WaveBank logo and related marks belong to HVTL.
Subject to these terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for their intended purposes. You may not copy, redistribute, sell, sublicense, or modify our software or materials without our written permission, except where the law allows it. Nothing in these terms transfers ownership of HVTL's intellectual property to you.
6. Feedback
If you send us ideas, suggestions or feedback, you allow us to use them freely, without payment or attribution, to improve and develop the Services. You don't have to send feedback.
7. New Features, Beta Features and Limits
We regularly add, change and remove features. New features are part of the Services and are covered by these terms when they launch. Some features may require you to accept additional terms, grant an additional permission (for example through Discord's own authorization screen), or meet other requirements before you can use them. We will ask for that when the feature needs it.
Some features may be labelled beta, preview or experimental. They may change or end at any time, may not work as expected, and are provided as is.
We may set and change limits on the Services, such as how many economies, accounts, linked servers, members, transactions or requests are allowed, and these limits may differ between free and paid plans.
8. Paid Features
Some features may be offered for a fee, for example premium plans, subscriptions or one-time purchases ("Paid Features"). If you buy a Paid Feature:
- The price, what is included, how billing works, and any renewal terms will be shown to you before you buy.
- Payments are handled by a third-party payment provider under its own terms. We do not store your full payment card details.
- Subscriptions renew automatically until you cancel. You can cancel at any time, and the cancellation takes effect at the end of the current billing period.
- Except where the law requires otherwise or where we say otherwise at the time of purchase, payments are non-refundable and partial periods are not refunded.
- We may change prices or what a plan includes. We will give reasonable notice before a price change affects an existing subscription, and you can cancel before it takes effect.
- You are responsible for any taxes that apply, unless they are included in the price shown.
- Disputing a valid payment with your bank (a chargeback) may lead us to suspend the Paid Feature or your access.
- If we suspend or end your access because you broke these terms, you may lose Paid Features without a refund, except where the law requires otherwise.
- Paid Features do not change the nature of Virtual Currency described in section 3.
9. Logging, Monitoring and Staff Access
To run the Services safely, we record activity. Activity such as payments, moderation actions, settings changes, and the commands, buttons and forms people use (including what is typed into them, with secret keys hidden) may be posted to log channels chosen by each economy and to HVTL's own staff channels. HVTL staff may look at data when operating the Services, providing support, investigating problems or abuse, or enforcing these terms, and staff access is itself logged. Our Privacy Policy explains this in detail.
10. Service Availability and Changes
We may update, change, add, restrict, suspend or discontinue any part of the Services at any time, including for maintenance or security. We will give notice where the law requires it. We do not promise that the Services will always be available or that any feature will stay available.
11. Security and Enforcement
You must not interfere with the security or integrity of the Services.
Where reasonably necessary, we may investigate, remove content, reset or remove Virtual Currency, freeze or delete economies or accounts, restrict features, unlink servers, or suspend or ban users or servers from the Services, temporarily or permanently. Where the law requires it, we will give you notice and a way to challenge the decision.
12. Third-Party Services
The Services rely on third parties, including Discord and our hosting and database providers. Your use of Discord remains subject to Discord's terms and policies. We do not control third-party services and are not responsible for their actions, outages or decisions, except where liability cannot legally be excluded. If Discord changes or removes something the Services depend on, some features may stop working.
13. Privacy
How we collect and use personal information is described in our Privacy Policy. Please read it. These terms do not replace any privacy notices, consents or rights the law gives you.
14. Disclaimers
To the maximum extent permitted by law, the Services and all Virtual Currency are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Services will be uninterrupted, error-free, secure in every situation, or that data will never be lost.
Nothing in these terms excludes warranties or protections that cannot legally be excluded.
15. Limitation of Liability
To the maximum extent permitted by law:
- HVTL will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data, goodwill, or Virtual Currency, arising from or related to the Services.
- HVTL's total liability for any claim related to the Services is limited to the greater of (a) the amount you paid HVTL for the Services in the 12 months before the claim arose, or (b) 50 US dollars.
Nothing in these terms excludes or limits liability where the law does not allow it.
16. Indemnity
To the extent permitted by law, you agree to defend and indemnify HVTL against claims, losses and costs (including reasonable legal fees) brought by third parties and arising from your breach of these terms, your misuse of the Services, or your violation of the law or of someone else's rights.
17. Changes to These Terms
We may revise these terms from time to time, for example when we add features. When we make a material change, we will tell you through the Services (for example in Discord or on the website) and ask you to accept the new version before you keep using the affected Services. The effective date and version at the top will be updated.
18. Ending This Agreement
You may stop using the Services at any time and ask us to delete your data as described in the Privacy Policy. We may suspend or end your access as described in section 11. Sections that by their nature should continue (including sections 3, 5, 6, 8, 14, 15, 16, 19 and 20) continue after this agreement ends.
19. Governing Law and Disputes
These terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-laws rules, subject to any mandatory consumer protections that apply where you live.
Before starting a formal dispute, please contact us at wavebank@email.hvtlab.net so we can try to resolve it informally within 30 days. Disputes that are not resolved will be handled by the state or federal courts located in North Carolina, unless the law where you live gives you the right to bring a claim elsewhere. Either party may bring a qualifying claim in small claims court.
20. General
- These terms, together with the agreements and policies they mention, are the entire agreement between you and HVTL about the Services.
- If any part of these terms is found unenforceable, the rest stays in effect.
- If we don't enforce a part of these terms, that doesn't mean we give up the right to enforce it later.
- You may not transfer your rights under these terms. We may transfer ours, for example as part of a merger, acquisition or sale of assets.
- We are not responsible for delays or failures caused by events outside our reasonable control.
- We may send you notices through the Services, by Discord direct message, on the website, or by email if you have given us one.

22. Acceptance
By accepting these Master Terms in Discord or on the website, or by using the Services where that counts as acceptance under the law, you agree to these Master Terms.
